Waukesha County Clerk Explains Additional Votes for David Prosser

The Waukesha County Clerk Kathy Nickolaus states that the 7,583 votes for David Prosser were just not "found" they had been recorded, but they unfortunately did not appear in her final tally when she reported.

Nicholaus went on to say that she failed to "save" a spreadsheet and thus had assumed they were included in submitted report. The votes are reported to be from the City of Brookfield.

Nicholaus also said, "I’m thankful that this error was caught early in the process and during the canvass," Nickolaus said. "The purpose of the canvass is to catch these kinds of errors."

Waukesha Finds 7500 Overlooked Votes for Prosser While Prosser Hires Attorneys that Represented George W. Bush in the 2000 Florida Recount

Justice David Prosser hired two attorneys that represented then, presidential candidate George W. Bush in the 2000 Florida recount when Vice President Al Gore suddenly found himself not being the winner of the state of Florida.

Prosser hires two attorneys from the suspicious Florida recount and Waukesha County Clerk's office suddenly produces more than 7,500 votes they did not count for David Prosser on election night.

Something is awfully suspcious in and smelly in Waukesha County and the David Prosser campaign.

Team Represents Best in State and National Legal Talent

(April 7, 2011—Delafield, WI) The Prosser for Supreme Court campaign is transitioning from campaigning to the expected legal efforts by assembling an exceptional recount team.

“Over the last 36 hours, we have put together an outstanding legal team, headed by Madison-based Attorney Jim R. Troupis to prepare for a statewide recount. Very Disturbing News in the Kloppenburg & Prosser Supreme Court Race

Somewhere out of thin air, the Waukesha County Clerk's office is reporting that they failed to include 7,582 votes for David Prosser in their election night reporting.

Waukesha County is a very strong Republican county and on election night they seemed to have overlooked more than 7,500 votes for "their" candidate. How smelly is this sudden revelation from a republican bastion? You be the judge.

Kloppenburg declares victory over Prosser in Supreme Court race

Supreme Court Election

Last night was an enormous victory for the hundreds of thousands of ordinary middle class people in Wisconsin who stood up to have their voices heard and to take back their government. Remember, just a few weeks ago in the Supreme Court primary election, Prosser lead Kloppenburg by a 55% – 25% margin. At the time, Prosser actually told the New York Times that he would “win this race going away”. But then along came Scott Walker who put Prosser and the Republicans in an extremely difficult situation, by trying to strip middle class workers of their collective bargaining rights.

The real credit for this victory belongs to the hundreds of thousands of students, teachers, nurses, correctional officers, administrative support staff, hospital workers, CNA’s, firefighters, police, and others who spent weeks in the streets using their voices and coming together at the grass roots level to stand firm against Walker’s overreach and attacks on working men and women.

The final vote is in, and Joanne Kloppenburg has won by a little more than 200 votes. Prosser and his right wing cronies are already clamoring for a recount. We must all take every caution to ensure the integrity of the recount process is protected, because as we all know over the last few months Walker and his minions have shown no respect for the law. We are concerned that this disrespect for the law will carry over into the recall process. We have to stay strong on our message that the voices of Wisconsin, standing up for our rights, will not be silenced.

Today’s victory propels all of us into a full court press on the recall efforts against those Republican senators who blindly followed Scott Walker as he attacked our rights. We are pumped. We are ready to continue the battle.

Over the next couple of days, the Joint Finance Committee will hold hearings in four locations around the state regarding the budget proposal. On Thursday, 4-7 they will be at UW Stevens Point; Friday, 4-8, at UW Superior; Monday, 4-11 at State Fair Park in Milwaukee and on Wednesday, 4-13 they will be in Arcadia. We know there will be hundreds if not thousands of working people attending these hearings, but there is always room for you, too. We strongly encourage all members and leaders to attend these JFC hearings. We suggest that you visit the SEPAC website (wseu-sepac.org) to make sure the meeting sites haven’t changed.

We thank all of you for your continued support, and urge you to draw stamina from this Supreme Court victory to keep up the good fight. Our success over the last 53 days is really defined by the Steel Workers slogan: One day longer. One day stronger.

Election Update: "Unofficial Report"

It appears that the "Unofficial" vote tally for the Wisconsin Supreme Court race will show Joanne Kloppenburg the winner by more than 200 votes.

The only precinct remaining to be filed is the Town of Lake Mills. Jefferson County officials are saying that the unofficial tally from that precinct shows Prosser gaining two (2) votes, thereby leaving Joanne Kloppenburg on top statewide by approximately 204 votes.

Both campaigns are reported to be assembling their legal teams for the recount activity.

It is further expected that the Associated Press will call the race for Joanne Kloppenburg very soon.

Again, we must stress, this information is all "unofficial" and is based on information coming from the vote observers.

Court Race May Come Down to the Town of Lake Mills (Updated)

With fewer than 200 votes separating incumbent Supreme Court Justice David Prosser and his challenger assistant attorney general JoAnne Kloppenburg, the election outcome could be affected by the Town of Lake Mills where all the votes have not yet been counted.

Because of problems with its tally seats, the township has not officially reported any vote tallies as of yet to Jefferson County and that means that between 700 and 760 votes have not been entered in the statewide totals for a seat on the state's highest court.

Election officials in the township were expected to meet at 8:30 a.m. this morning to finish counting 24 paper ballots that have not yet been counted, make the necessary correction to their tally sheets and then report their vote totals to the County Clerk's office at the courthouse. But that meeting did not occur because of a lack of a quorum of the town's Board of Canvassers. A new meeting time has been officially posted by town officials and is now scheduled to begin at 11:45 a.m.

Given the closeness of the race for a 10-year term on the court (which is likely to be headed for a statewide recount), the township's vote totals could be a factor in determining which candidate goes into the expected recount on top.

The 1 Precinct Not Counted is Lake Mills, WI

The Lake Mills Leader is reporting election officials in the Town of Lake Mills won't meet until 11:45am to finalize the vote there.

Township officials were scheduled to meet at 8:30am to finish counting the final 24 paper ballots, but lacked a quorum.

With Milwaukee officials saying all of their votes are in, the Lake Mills votes may be the final ones to be tallied in the Supreme Court race.

The paper reported the township has yet to report any of the 700 to 760 votes cast there to Jefferson County.

Could There Be a Recount?

According to GAB there is no such thing as an automatic recount.

A candidate has to ask for a recount, and it's free so long as the difference is less than one half of 1 percent.

If the difference is one half of 1 percent and 2 percent, the cost to the candidate is $5.00 per ward. If the difference is more than 2 percent, the candidate requesting the recount has to pay for all of the costs.

According to GAB, a recount cannot be requested until all of the county boards of canvass are in. That would not likely occur until Monday, 04/11 or Tuesday, 04/12.

Candidates then have three business days after the last canvass comes in to request a recount.

They call it "tweaks" to Governor Scott Walker's budget proposal. Well pat yourself on the back Rep. Robin Vos. You think your co-chair muscle flexing at your Governor's budget proposal is winning you any friends in the real world? I think not. This budget proposal needs an incinerator.

On another note, Sen. Alberta Darling says she would like to see an incentive offered to state employees for bringing "cost-saving" ideas forward. What will that be Sen. Darling, a little bread to go with their water? YOU and your Republican Majority took away the greatest incentive for state employees and other public employees. THEY WILL BE FIRED WITHOUT CAUSE!

As the article states and as Judge Sumi has stated in a court hearing, this matter could be cleared up if the legislature would simply bring the bill back into the legislative process and proceed legally this time. The GOP Majority refuses to bring it back at this time. I think they are afraid to bring it back because they no longer have the votes to pass the bill. I think several GOP will defect from supporting the anti-collective bargaining bill, as they should have during the first round of this illegal legislative action.

"If Prosser wins all of Walkers bills will go into effect, if Kloppenburg wins everything will be blocked and we are dead". This says it all. Vote Kloppenburg.
