District IV Court of Appeals Ask Supreme Court to Take Up Collective Bargaining Suit

The District IV Court of Appeals has certified to the Wisconsin State Supreme Court the case of Dane County DA Ozanne seeking to block publication of Wisconsin Act 10, the controversial anti-collective bargaining bill. Four justices of the Supreme Court will have to agree to accept the case.

The appeals court justices of Lundsten, Higgenbotham and Blanchard, J.J. is asking the Wisconsin Supreme Court if "striking down" a legislative bill for violation of the Wisconsin Open Meetings law is an available remedy and if so whether a court has the authority to enjoin the secretary of state's publication of an act before it becomes law.
